6. Subscription and Payment

Certain features of the Service require a paid subscription:

  • Subscription fees are billed in advance on a monthly basis
  • All fees are non-refundable except as required by law
  • You authorize us to charge your payment method for all fees
  • We may change subscription fees upon 30 days' notice
  • Failure to pay may result in suspension or termination of your account

7. Free Trial

We may offer a free trial period for new users. At the end of the trial period, your account will require a paid subscription to continue using the Service. We reserve the right to modify or discontinue the free trial at any time without notice.

8. Usage Limits

Your subscription plan includes specific limits on leads, emails, and other features. These limits reset daily at midnight UTC. Exceeding your limits may result in temporary restrictions on your account until the next reset period or until you upgrade your plan.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Leadsmaxxing Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our express written permission.

10. Data Accuracy

While we strive to provide accurate lead information, we do not guarantee the accuracy, completeness, or reliability of any data provided through the Service. Lead data may become outdated or contain errors. You are responsible for verifying the accuracy of any information before use.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

IN NO EVENT SHALL LEADSMAXXING INC., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Leadsmaxxing Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through your account settings or by contacting us.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
